Terms of Service

These Terms of Service ("Terms") govern your access to and use of CosmicLeads ("the Service"), operated by CosmicLeads ("we," "us," or "our"). By subscribing to or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

CosmicLeads is a data subscription service that delivers daily curated expired listing information to licensed real estate professionals. Deliveries are sent via email in CSV format and include property information compiled from MLS API data and publicly available records including county tax records.

2. Eligibility

The Service is intended exclusively for licensed real estate professionals. By subscribing, you represent and warrant that you hold a current, valid real estate license in the state(s) in which you operate. CosmicLeads reserves the right to terminate any subscription if it is determined that the subscriber is not a licensed real estate professional.

3. Individual License — Non-Transferable

Each subscription is an individual license issued to a single named agent. Your subscription is personal to you and may not be shared, transferred, resold, or used by any other individual or entity.

The following are strictly prohibited and constitute a material breach of these Terms:

  • Sharing your login credentials or delivery access with any other person
  • Forwarding, distributing, or redistributing CSV files or any data contained therein to any third party
  • Using a single subscription to serve multiple agents, team members, or offices
  • Reselling or sublicensing any data received through the Service
  • Incorporating CosmicLeads data into any competing product or service

Violation of this section will result in immediate suspension of your subscription with no refund issued. No exceptions.

4. Team and Brokerage Use

Teams, brokerages, or offices requiring multi-agent access must contact CosmicLeads directly to establish a custom arrangement. Using a single individual subscription to serve multiple agents is a violation of these Terms regardless of office structure or internal agreement.

5. Subscriber Responsibilities

You are solely responsible for how you use the data delivered through the Service. By subscribing, you acknowledge and agree that:

  • You are a licensed real estate professional and understand applicable laws governing real estate prospecting
  • You are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the National Do Not Call Registry, Florida state calling regulations, and any other applicable federal, state, or local laws governing outbound calls and communications
  • CosmicLeads is a data service only. We do not make calls on your behalf and bear no responsibility for how you use the contact information provided
  • You will not use the data for any purpose other than legitimate real estate prospecting within the scope of your license
  • You will not use the data to harass, spam, or contact individuals in violation of any applicable law

6. Data Accuracy

CosmicLeads compiles data from MLS API feeds and publicly available records. While we make reasonable efforts to ensure accuracy, we do not guarantee that all data is complete, accurate, or current. Phone numbers, property details, and ownership information may contain errors or may change after delivery. CosmicLeads is not liable for any inaccuracies in the data provided.

7. Subscription, Billing, and Cancellation

Subscriptions are billed on a monthly or annual basis as selected at checkout. All payments are processed securely through Stripe. By subscribing, you authorize CosmicLeads to charge your payment method on a recurring basis until you cancel.

  • Monthly subscriptions may be cancelled at any time and will remain active through the end of the current billing period
  • Annual subscriptions may be cancelled at any time and will remain active through the end of the annual term. No partial refunds are issued for unused months on annual plans.
  • One-time purchases (including The Method Prospecting Guide and coaching sessions) are non-refundable once delivered or fulfilled

8. SMS Notification Program

CosmicLeads offers an optional SMS text message notification program to subscribers. Enrollment is never required to subscribe to or use the Service. By checking the SMS opt-in box during signup and providing your mobile phone number, you agree to the following SMS program terms:

  • Program Name: CosmicLeads Subscriber Notifications
  • Program Description: By opting in, you agree to receive SMS text messages from CosmicLeads related to your subscription, including but not limited to new expired listing lead alerts, account and billing notifications, service updates, and customer support communications.
  • Message Frequency: Message frequency varies based on your account activity and lead upload schedule. You may receive up to approximately 10 messages per week.
  • Cost: Message and data rates may apply. CosmicLeads does not charge for SMS messages, but your mobile carrier may. Check with your carrier for details.
  • HELP Instructions: Reply HELP to any message for assistance, or contact support at or 786-284-6479.
  • STOP Instructions: Reply STOP to any message to unsubscribe from SMS notifications at any time. You will receive one final confirmation message acknowledging your opt-out, after which no further SMS messages will be sent unless you opt back in.
  • Supported Carriers: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, and other major U.S. carriers. Carriers including T-Mobile are not liable for delayed or undelivered messages.
  • Consent: SMS consent is not a condition of purchase. You may subscribe to CosmicLeads without enrolling in SMS notifications, and you may opt out of SMS at any time without affecting your subscription.

For details on how we handle your mobile phone number and SMS opt-in data, see Section 3 of our Privacy Policy. We do not share mobile phone numbers or SMS opt-in data with any third parties or affiliates for marketing purposes.

9. Suspension and Termination

CosmicLeads reserves the right to suspend or terminate any subscription immediately and without refund if:

  • The subscriber is found to be in violation of the individual license terms (Section 3)
  • The subscriber is found to be using the data in a manner that violates applicable law
  • The subscriber is not a licensed real estate professional
  • Payment is not received or a chargeback is filed

10. No Refund Policy for Violations

Subscriptions terminated due to violations of these Terms — including but not limited to unauthorized sharing of data or access — will not be refunded under any circumstances. Initiating a chargeback in connection with a violation will be treated as fraud and reported accordingly.

11. Intellectual Property

The CosmicLeads brand, website, delivery format, and all associated materials are the intellectual property of CosmicLeads. The data delivered through the Service may not be used to build competing products, databases, or services.

12. Limitation of Liability

CosmicLeads shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to lost revenue, lost listings, or failed business outcomes. Our total liability to you shall not exceed the amount paid by you in the three months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. CosmicLeads makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Miami-Dade County, Florida.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will notify active subscribers of material changes via email.
